A. Information You Provide Directly: full name, email, telephone or mobile number, mailing address, company or organization, property preferences and search criteria, inquiry content and correspondence, and documents you upload or transmit (e.g., letters of intent, financial statements, identification).
B. Information Collected Automatically: IP address and approximate geolocation derived from IP, browser type and version, operating system and device identifiers, pages visited, time on page, click events, scroll depth, referring URLs, and cookies, pixels, web beacons, local storage, and similar technologies.
C. Information from Third Parties: Multiple Listing Service (MLS) databases, real estate platforms, property data aggregators and public records (county appraiser, recorder, tax rolls), social media platforms, and marketing, advertising, and analytics partners.
D. Sensitive Information: We do not intentionally collect Social Security numbers, government identification numbers, financial account credentials, biometric data, precise geolocation, racial or ethnic origin, religious beliefs, health information, sexual orientation, or other categories of “sensitive personal information” under the California Consumer Privacy Act (“CCPA”), Florida Digital Bill of Rights (“FDBR”), or the EU/UK General Data Protection Regulation (“GDPR”), except where you voluntarily provide such information in connection with a specific transaction. We will treat such information with appropriate safeguards.
We process your information to: respond to inquiries and schedule appointments; provide property listings, market analyses, and brokerage services; send marketing emails, SMS, newsletters, and listing alerts; operate, maintain, and improve the Site; personalize content and analyze usage; comply with legal obligations including real estate licensing, tax, and anti-money-laundering rules; detect, prevent, and address fraud, security incidents, or unlawful activity; and establish, exercise, or defend legal claims. For users in the EU/UK, processing is based on performance of a contract, your consent, our legitimate interests, or legal obligation, as applicable.
Express Written Consent. By providing your mobile number on a Chariff form, by checking an SMS opt-in box, or by texting us first, you provide your express written consent to receive recurring autodialed and pre-recorded SMS or MMS messages from Chariff Realty Group, including for marketing, listing alerts, transactional updates, and conversational follow-ups. Consent is not a condition of any purchase, service, or transaction.
Message frequency varies based on your activity and engagement. Standard message and data rates from your carrier may apply. Reply HELP to any message for assistance, or email info@chariff.com. Reply STOP to any message to immediately and permanently opt out. You may also email info@chariff.com with the subject “STOP SMS.” Major U.S. carriers are supported, and carriers are not liable for delayed or undelivered messages. Chariff maintains records of opt-in events as required by the Telephone Consumer Protection Act (“TCPA”) and applicable A2P 10DLC requirements.
When you submit your email address or opt in via a form, you consent to receive transactional and marketing email from Chariff. Every marketing email contains a one-click unsubscribe link. You may also email info@chariff.com to be removed from our marketing lists. We honor opt-out requests within ten (10) business days as required by the federal CAN-SPAM Act.
We do not sell your personal information for monetary consideration. We may share your information with: service providers (website hosting, email and CRM platforms, SMS providers, analytics providers, advertising platforms, e-signature platforms, and similar vendors, each bound by written confidentiality and data processing terms); real estate counterparties (property owners, landlords, sellers, cooperating brokers, attorneys, title companies, lenders, and inspectors, as reasonably necessary to facilitate a transaction in which you are involved); legal and regulatory authorities when required by law, subpoena, court order, or to protect our rights, property, or safety; and successors in connection with a merger, acquisition, financing, reorganization, or sale of all or a portion of our business or assets, or with your consent.
Cross-Context Behavioral Advertising / “Sale” or “Share” under CCPA. Chariff uses third-party advertising and analytics technologies that may involve “sharing” personal information for cross-context behavioral advertising as defined under California, Florida, and other state privacy laws. Residents of those states have the right to opt out — see Section 12.
Chariff is based in the United States. If you access the Site from outside the United States, your information will be transferred to, stored, and processed in the United States. By using the Site, you consent to such transfer. For transfers from the EU, UK, or Switzerland, we rely on Standard Contractual Clauses or other lawful transfer mechanisms with our service providers.
The Site uses cookies, pixels, web beacons, and similar technologies to operate essential Site functions, remember your preferences, analyze traffic and Site performance, and deliver and measure advertising. You may refuse or delete cookies through your browser settings, opt out of Google Analytics at https://tools.google.com/dlpage/gaoptout, and opt out of interest-based advertising at http://optout.aboutads.info or https://www.networkadvertising.org/choices. We honor the Global Privacy Control (“GPC”) signal as an opt-out of “sale” and “sharing” where required by applicable state law. Disabling cookies may affect Site functionality.
We retain personal information for as long as needed to fulfill the purposes described in this Policy, comply with legal, accounting, tax, or regulatory obligations (including Florida real estate brokerage record-retention requirements, generally five (5) years), resolve disputes, and enforce agreements. When information is no longer needed, we delete or anonymize it.
We maintain reasonable administrative, technical, and physical safeguards designed to protect personal information against unauthorized access, disclosure, alteration, and destruction, including encrypted transport (HTTPS/TLS), access controls, vendor due diligence, and limited employee access on a need-to-know basis. No system is impenetrable; we cannot guarantee absolute security and disclaim liability to the extent permitted by law for any unauthorized access not caused by our gross negligence or willful misconduct. In the event of a breach of unencrypted personal information that triggers a notification obligation under Florida Statute §501.171 or other applicable law, we will provide notice to affected individuals and regulators within the timeframes required by law.
The Site is not directed to children under thirteen (13). We do not knowingly collect personal information from children under thirteen (13). If we learn we have collected such information, we will delete it. Parents or guardians who believe a child has provided information may contact info@chariff.com.
Depending on where you reside, you may have the rights set forth below. To exercise any right, email info@chariff.com with the subject line “Privacy Request” and identify the jurisdiction and right you are exercising. We will verify your identity before fulfilling any request and will respond within the timeframes required by applicable law.
A. California Residents (CCPA / CPRA): right to know what personal information we collect, use, disclose, and “share”; right to delete (subject to exceptions); right to correct; right to opt out of “sale” or “sharing” for cross-context behavioral advertising; right to limit use of sensitive personal information; right to non-discrimination for exercising your rights.
B. Florida Residents (Florida Digital Bill of Rights): if we meet the FDBR’s controller threshold, you have the right to confirm processing, access, correct, delete, obtain a portable copy of, and opt out of the sale of personal information, targeted advertising, and certain profiling.
C. EU, UK, EEA, and Swiss Residents (GDPR / UK GDPR): right of access, rectification, erasure, restriction, data portability, and objection to processing; right to withdraw consent at any time without affecting the lawfulness of prior processing; right to lodge a complaint with your data protection authority.
D. Other U.S. State Residents: residents of Colorado, Connecticut, Virginia, Texas, Utah, Oregon, Montana, Tennessee, Indiana, Iowa, and other states with comprehensive privacy laws may have similar rights. Contact us to exercise applicable rights.
E. Authorized Agents and Appeals: you may designate an authorized agent to make a request on your behalf, subject to verification. If we deny a request, you may appeal by replying to our denial; we will respond within sixty (60) days. If unresolved, you may contact your state attorney general or applicable regulatory authority.
Our Site does not respond to browser “Do Not Track” signals. We do honor the Global Privacy Control (“GPC”) signal as an opt-out of “sale” and “sharing” where required by applicable state law.
The Site contains links to third-party websites and embedded third-party services (including Google Maps, MLS feeds, and social media plug-ins). We are not responsible for the privacy practices or content of such third parties. Review their privacy policies before providing information.
We may update this Policy from time to time. The “Last Updated” date at the top reflects the most recent revision. Material changes will be communicated through a Site notice or email. Your continued use of the Site after the effective date of any update constitutes acceptance.
The Site is intended for users 18 years of age or older. By using the Site, you represent that you meet this age requirement and have the legal capacity to enter into these Terms. Subject to your compliance, we grant you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to access and use the Site for personal, non-commercial purposes related to evaluating real estate inquiries with Chariff. All other uses are prohibited.
You agree not to: use the Site for any unlawful purpose; scrape, harvest, copy, or extract listings, data, images, or content for any commercial purpose without our prior written consent; reverse-engineer, decompile, or disassemble the Site; interfere with or disrupt the Site, servers, or networks, including by uploading viruses or malicious code; misrepresent your identity, affiliation, or authority; use automated means (bots, spiders, crawlers) except as expressly permitted by our robots.txt; or circumvent any technical or security measures.
All content on the Site, including text, graphics, logos, images, photographs, videos, software, listings, and the design and “look and feel,” is owned by or licensed to Chariff and is protected by copyright, trademark, and other intellectual property laws. The “Chariff Realty Group” name and logo are trademarks of Chariff Realty Group, Inc. Listing photographs and data may be subject to MLS rules and copyright held by photographers, sellers, or MLS providers.
If you submit any inquiry, message, document, or other content to us through the Site, you grant Chariff a worldwide, non-exclusive, royalty-free, transferable license to use, reproduce, modify, and display such content in connection with the operation of our business and the response to your inquiry. You represent that you have all necessary rights to grant this license and that the content is not unlawful, infringing, or harmful.
Property listings, descriptions, dimensions, square footage, zoning, financial data, photographs, and other information are provided by sellers, landlords, MLS feeds, and third parties and have not been independently verified by Chariff. All information is provided “AS IS” without warranty of any kind, express or implied, including merchantability, fitness for a particular purpose, accuracy, or non-infringement. Each prospective party must independently verify all information.
Chariff Realty Group will recognize only a Florida-licensed real estate broker who exclusively represents a prospective tenant, lessee, buyer, purchaser, investor, assignee, or other principal (each, a “Principal”) in connection with any property listed, marketed, advertised, or otherwise made available by Chariff (each, a “Property”), and only where such broker’s representation has been (a) disclosed to Chariff in writing by the Principal, (b) supported by a fully executed exclusive representation agreement between such broker and the Principal, and (c) acknowledged in writing by an authorized officer of Chariff, all prior to the broker’s, the Principal’s, or their agents’ first contact, inquiry, communication, tour, showing, request for information, submission of offer, term sheet, letter of intent, or proposal involving Chariff, the listing agent, the property owner, or the Property. No broker shall be recognized, and no claim for commission, fee, referral, override, or other compensation shall be considered, in the absence of strict, prior, written compliance with each of the foregoing requirements. No retroactive registration, disclosure, claim, or after-the-fact submission of representation agreements will be accepted under any circumstance.
Nothing on this website, in any listing, marketing material, response to inquiry, tour, communication, or other interaction shall be construed as creating any agency, representation, fiduciary, employment, partnership, joint venture, or commission-bearing relationship between Chariff and any party. The common-law doctrine of procuring cause shall not apply, and no implied or quasi-contractual right to compensation shall arise, absent a separate, prior, written agreement signed by an authorized officer of Chariff. Chariff expressly reserves the right to deal directly with any Principal, owner, or other party on a non-represented basis at any time.
This website and its contents do not constitute an offer, agreement, promise, inducement, or commitment to pay any commission, fee, or compensation of any kind. Pursuant to Section 725.01, Florida Statutes, and applicable law, any agreement for the payment of a commission or fee in connection with the sale, lease, or other transfer of real estate is unenforceable unless in writing and signed by the party to be charged. Any compensation that may be paid by Chariff shall be subject solely to a separate written agreement, executed in advance by an authorized officer of Chariff, in Chariff’s sole and absolute discretion.
As a Florida-licensed real estate brokerage, Chariff operates as a transaction broker by default in accordance with Sections 475.278 and 475.2755, Florida Statutes, unless a single-agent or no-brokerage relationship is expressly established in writing in advance. As a transaction broker, Chariff and its associates owe limited duties including dealing honestly and fairly, accounting for all funds, using skill, care, and diligence, disclosing all known facts that materially affect the value of residential real property and are not readily observable, and presenting all offers and counteroffers in a timely manner. No fiduciary duties are owed.
Information made available through this website, including off-market listings, financial details, ownership information, tenant or occupancy data, and pricing information, is provided in confidence for the recipient’s evaluation of a specific potential transaction only. Any party who receives such information agrees not to (a) circumvent Chariff, (b) contact owners, tenants, or principals directly for the purpose of bypassing Chariff, (c) share such information with third parties, or (d) use such information for any purpose other than the bona fide evaluation of the specific Property or transaction described. Violation of this provision shall entitle Chariff to all available remedies, including injunctive relief and recovery of any commission that would otherwise have been earned.
Chariff complies with the federal Fair Housing Act, the Florida Fair Housing Act, the Americans with Disabilities Act, and all applicable equal-opportunity, anti-discrimination, and accessibility laws. All inquiries are handled without regard to race, color, religion, sex, national origin, disability, familial status, age, or any other classification protected by applicable law.
THE SITE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, CHARIFF DISCLAIMS ALL WARRANTIES, EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, AND UNINTERRUPTED OR ERROR-FREE OPERATION.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL CHARIFF, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOST PROFITS, LOST DATA, OR LOST BUSINESS OPPORTUNITIES, ARISING OUT OF OR RELATING TO YOUR USE OF THE SITE, REGARDLESS OF THE LEGAL THEORY ASSERTED, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. CHARIFF’S AGGREGATE LIABILITY SHALL NOT EXCEED ONE HUNDRED DOLLARS ($100). NO PROVISION OF THESE TERMS SHALL CREATE RIGHTS IN OR BE ENFORCEABLE BY ANY THIRD PARTY.
You agree to defend, indemnify, and hold harmless Chariff and its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or relating to your use of the Site, your violation of these Terms, or your violation of any law or third-party right.
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Site shall be brought exclusively in the state or federal courts located in Miami-Dade County, Florida, and each party submits to the exclusive personal jurisdiction of such courts and waives any objection to venue or forum non conveniens. As a condition precedent to filing suit, the claimant shall provide thirty (30) days’ written notice and a reasonable opportunity to cure. The prevailing party shall be entitled to recover reasonable attorneys’ fees and costs at trial and on appeal.
We may suspend or terminate your access to the Site at any time, with or without cause, with or without notice. Upon termination, the provisions that by their nature should survive shall survive. If any provision is held invalid or unenforceable, the remaining provisions shall remain in full force and effect, and the unenforceable provision shall be reformed to the minimum extent necessary to be enforceable. No waiver shall be effective unless in writing. These Terms, together with the Privacy Policy and Accessibility Statement on this page, constitute the entire agreement between you and Chariff regarding the Site.
By accessing this website, requesting information, viewing a Property, submitting any inquiry, offer, or proposal, or otherwise engaging with Chariff or any Property marketed by Chariff, each party acknowledges, accepts, and is bound by these Terms. Such party further confirms that any failure to comply constitutes a complete and irrevocable waiver of any broker, commission, or compensation claim against Chariff.
